Terms of Service

Nothing on this page is a binding agreement between you and Prism AI Apps LLC, and no part of it should be relied on. A final version will replace it, and this notice will be removed when it does.
Who these terms are between
These terms are between Prism AI Apps LLC, a United States limited liability company (“GeoGiving”, “we”), and the organization that creates an account to raise money using the service (“you”). A person who makes a donation or buys a ticket through a page hosted by GeoGiving is a donor. Donors are not party to these terms; their relationship is with the organization they gave to.
What GeoGiving is, and what it is not
GeoGiving is software. We provide the tools an organization uses to publish campaigns, donation forms, ticketed events and peer-to-peer fundraising pages, and to see the resulting records.
We are not a charity, we do not solicit donations on our own behalf, and we are not the recipient of any donation made through the service. We do not provide legal, tax or accounting advice.
How money moves
Payments are processed by Stripe. You connect your own Stripe account and enter into Stripe’s agreement directly with Stripe. Donations and ticket payments are charged to the donor and settle into your Stripe account. GeoGiving does not receive, hold, control or disburse donated funds at any point, and card details are entered with Stripe and never reach GeoGiving’s systems.
Payouts, payout timing, holds, reserves and chargebacks are governed by your agreement with Stripe. We cannot release a payout Stripe has held.
Our fees
Our standard platform fee is 2.5% of each transaction for donation forms and campaign donations, and 3.5% for ticketed events and for donations raised through peer-to-peer pages. It is collected at the time of the transaction.
A payment is charged one rate and one only; the rates do not combine. The rate is determined by what the payment is — a gift made directly to a campaign is charged the standard rate even where that campaign also runs peer-to-peer pages. Free registrations carry no percentage fee.
The applicable rate is resolved and fixed at the moment a payment is created, and a later change to our rates or to your settings does not alter a payment already made. The rate that applies to you is shown in your account before you publish, and is the rate used in every figure presented to your donors.
Stripe’s processing fees are separate, are charged by Stripe, and are not marked up by us. A donor may optionally choose to cover our fee and the estimated processing fee. That choice is the donor’s, is never pre-selected for them, and is disclosed before they pay.
Any optional paid subscription is billed to your organization and is not taken from donations. We will give notice before changing our fees.
Your responsibilities
You are responsible for the accuracy of what you publish: what you are raising money for, how funds will be used, and your organization’s identity and status. You are responsible for issuing donor receipts and for any statement about the tax treatment of a gift. Where a ticket or benefit is provided in exchange for a payment, you are responsible for the value you state for it.
You are responsible for complying with the charitable solicitation, registration and disclosure laws that apply to you, and for having the right to use the names, images and materials you upload — including permission for any identifiable person shown in them.
You are responsible for the people you invite to your workspace and for what they do with the access you give them.
What you may not do
You may not use the service to raise money by deception, to solicit for an organization or purpose you do not represent, for anything unlawful, or in a way that violates Stripe’s restricted business rules. You may not attempt to reach data belonging to another organization on the platform, or to circumvent the access controls that keep organizations separate.
Your data and your donors’ data
The records your organization creates are yours. We process donor personal information on your behalf and for the purpose of running the service, as described in our privacy policy.
You can export your data at any time while your account is active. If you stop paying for an optional subscription we do not delete your data, and your transaction and donor records remain accessible to you.
Suspension and ending the agreement
You may close your account at any time. We may suspend an account where we are required to, where we reasonably believe it is being used to defraud donors, or where Stripe has terminated the underlying payment capability. Where we can give notice first, we will.
Ending this agreement does not affect a donation that has already been made or the records of it, and does not relieve you of obligations to your donors.
Service availability, warranties and liability
We work to keep the service available and correct, but it is provided as is. We do not warrant that it will be uninterrupted or error free.

These are the clauses most sensitive to the entity, its state and its insurance, and drafting a number here without that context would be inventing one. ]
